Subject: The exchange rate on the day of the debt acknowledgment will be the basis for calculating and confirming the foreign exchange claims of creditors in the bankruptcy process

On Sunday, April 8, 2025, an important session was held in the Supreme Court, during which a new procedural unanimity decision was issued regarding the method of certifying the foreign exchange claims of bankrupt creditors.

According to the decision of the Supreme Court judges, the exchange rate on the day of the declaration of the debtor will be the basis for calculating and acknowledging the foreign exchange claims of creditors in the bankruptcy process. This procedural unanimity decision has been issued with the aim of creating unity of opinion in the decisions of the appellate courts and resolving the procedural discrepancies.

In this session, the judges, after examining the differences of opinion between the different branches of the appellate courts, announced the majority decision as follows:

Majority (75 people): Confirmation of the opinion of Branch 18 of the Court of Appeals of Tehran Province

The First Minority (36 Members): Confirmation of the Opinion of Branch 35 of the Appeals Court of Tehran Province

Second Minority (10 People): Confirmation of the opinion of Branch 12 of the Court of Appeals of Kermanshah Province
