With the establishment of the new supervisory association, the actions of the previous association are contrary to the regulations of the Iran Chamber of Commerce.

 

In response to news circulating on social media regarding the list of candidates whose qualifications were approved for the presidency of the Iran Chamber, the Chamber issued a statement.

The statement refers to the final court ruling on the legality of the Iran Chamber's board election and the appointment of the Chamber's president, stating:

Any future election can only take place by order of a judicial authority, and the legal aspects of this issue must be addressed once the Supervisory Board is formed.

In fulfilling its legal duties and in preparation for any potential upcoming elections, the Iran Chamber has initiated the formation of the Supervisory Board, and the necessary information has been sent to the Ministry of Industry, Mine, and Trade (Ministry of IMT) for the appointment of its representative. Naturally, once the ministry's representative is appointed to the Supervisory Board, legal actions will proceed accordingly with legal considerations.

With the selection of new members of the Supervisory Board, any correspondence or actions taken by the former Supervisory Board that are contrary to the Iran Chamber's regulations are legally and executively invalid.

Postscript - As I mentioned earlier:

It seems that the decision of the First Appeal Branch of the Administrative Court, based on the new Administrative Court law, may provide a resolution for the complaint filed by the Chamber.

However, several interesting points are worth noting:

First:

The final ruling of Branch 1052 of the Tehran Criminal Court has confirmed the validity of the Chamber presidency election. It appears that as long as the court ruling remains in effect, no individual or entity can resist, refuse, obstruct, or challenge the final ruling of the criminal court.

Second:

According to the regulations, the Supervisory Board consists of 5 members, 4 of whom are appointed by the Chamber of Commerce, and 1 is appointed by the Ministry of IMT.

Third:

According to the letter published in this post, Dr. Hossein Mir Mohammad Sadeghi is no longer a member of the Supervisory Board, and the Board has not registered or taken any action regarding the elections, nor has it conducted any inquiries to assess candidate qualifications.

Fourth, and perhaps more interesting:

Among the names announced, many individuals, including Mahmoud Tolayi, Ali Akbar Abdolmaleki, and Ghadir Ghiaseh, have expressed that they were entirely unaware of their candidacy.

What a mess this political-legal dispute has become!
