In a recent meeting with the head and board of the Central Bar Association, Mohseni Ejei responded to their proposal to eliminate Paragraph 48 of the Criminal Procedure Code, which aims to ensure that all lawyers can equally and without favoritism defend defendants in security and political cases in courts and prosecutor's offices. He explicitly stated that he has proposed the removal of this paragraph to the government and parliament.

Abdi Media suggests that given the Chief Justice's positive stance and considering that the preparation of legal bills is within his purview, and according to the interpretation of the Guardian Council, the government cannot significantly amend or revise legal bills, the Chief Justice's positive opinion on amending a law or part of it is very important. Furthermore, since there is no financial burden associated with this matter that could lead to objections from the Guardian Council, it would be effective to have Mohseni Ejei consult with the chairman and members of the Legal and Judicial Committee of the Parliament through his legal and parliamentary affairs deputy or the Minister of Justice, and reflect this positive opinion. They should gather signatures to present the proposed elimination of Paragraph 48 as an urgent legislative bill to the Parliament's presidium.

This approach would prevent delays in government committees, approval by the Council of Ministers, submission of the bill to the Speaker of the Parliament, and the lengthy legislative process in the Parliament.

Given that the chairman and members of the Legal and Judicial Committee of the Parliament are mostly judges, understanding and accepting the proposal within the Parliament will be more straightforward.

Thus, with the government representative defending this legislative proposal and justifying it to the committee members in the session, other representatives are likely to vote in favor once they are informed of the judiciary’s approval and have the green light.

If the Chief Justice and revolutionary representatives implement this solution, the major issue facing the legal community, the judiciary, and all those accused of security-related crimes will be resolved more quickly, and the controversy surrounding this legal innovation and its limitations on legal practice and fair trial processes will come to an end.
