Mr. Gholam Hossein Mohseni Ejei, Head of the Judiciary.

 

Given your thorough familiarity with the past and present of Branches 36, 54, 21, and 34 of the Tehran Provincial Court of Appeals and their respective judicial committees, as well as your awareness of the sensitivity surrounding the cases of your esteemed colleagues, Ms. Niloufar Hamedi and Ms. Elaheh Mohammadi, in both the media and international arenas, it is appropriate to:

1. Emphasize through the Chief Justice of Tehran Province to his deputy in charge of the Appeals Courts that after the objections raised by the defendants and their honorable lawyers to the issued verdict, it should be referred, as much as possible, to another branch of the aforementioned courts.

2. Since, with the authorization of Ayatollah Khamenei, contrary to the Criminal Procedure Code, the Appeals Courts are conducting hearings and issuing definitive rulings without obtaining the statements of the parties involved in the case, particularly the defendants—unless the presiding judge deems the presence of individuals necessary—it is recommended to the referring branch that a hearing session be held in person and that the defenses of the defendants and their lawyers be carefully listened to.

3. It seems that the different and contradictory interpretations of "hostile governments" and the countries that fall under this category should now be clearly specified by the Secretary of the Supreme National Security Council and related resolutions and officially communicated to the court. Furthermore, these names should be formally reported to the public and media in accordance with Article 11 of the Law on Publication and Access to Information.

In light of your own statements regarding dialogue, please heed these heartfelt remarks of mine for the country, the judiciary, and the media community, and take appropriate action and measures.
