Qadiyani, the disciplinary prosecutor of judges, referring to Article 2 of the Family Protection Law, stated that family court sessions must be held with the presence of the president and a judicial advisor. He emphasized that if the session is held without the presence of the judicial advisor, the court will not be official, and family judges must pay attention to this important issue.

This comes as the head of the Supreme Court, Montazeri, in a circular issued on September 16, 2024, addressed the specialized family courts in the Supreme Court. He referred to the unification ruling 741 dated June 16, 2015, and the inspections of the primary and appellate family courts in Tehran and Alborz provinces. He mentioned that the absence of a female judicial advisor in accordance with Article 2 of the Family Protection Law is permissible and reminded the specialized family courts of the Supreme Court not to annul cases for lack of a female judicial advisor, as it does not constitute an investigative deficiency.
