The news received by Abdi Media indicates that, according to a ruling by the 87th Branch of the Tehran Court of Appeals, the regulation that was illegally drafted and approved without following proper procedures and without the approval of the Chamber of Commerce's Board of Representatives in the High Supervisory Council during Fatemi Amin's tenure as minister, has been declared null and void.

 

The final verdict issued by the Tehran courts on the annulment of the decision dated 2023/01/10 by the Supreme Supervisory Council of the Iran Chamber of Commerce conveys a message of safeguarding the independence of the Chamber's board of representatives as the private sector's parliament against the extralegal oversight (interference) of the Supreme Council.

The amended regulations approved by the Supreme Supervisory Council were annulled in the Court of Appeals.

According to this ruling by the Tehran Court of Appeals, the illegal decision by the Supreme Supervisory Council, which had created all the controversies surrounding Iran's private sector and led to interference in the Iran Chamber of Commerce elections, was deemed unlawful and was nullified.

Given the final annulment of this regulation in the Court of Appeals, all interpretations and opinions of the Supreme Supervisory Council related to this regulation are effectively suspended and void.

The effects of the ruling number 8821, dated 2023/11/21, from Branch 87 of the Tehran Court of Appeals on the decision dated 2023/10/23 of the Supreme Supervisory Council:

1- The repeal of the clause under section 7/2 of the amended regulations.

2- The absence of authority for the former supervisory association to hold the elections stipulated in the decision dated 2023/10/23 by the Supreme Supervisory Council.

3- The recent decision of the Supreme Supervisory Council being rendered ineffective in practice.

As a result, the current board of directors will continue their work with the existing composition.
