Ali Alqasi-Mehr, the head of the Tehran Judiciary, explained the observance of the deadlines of Article 242 of the Criminal Procedure Code by the Court of Appeals branch in Tehran, regarding the temporary release of Ms. Elaheh Mohammadi and Niloofar Hamedi until the final verdict is issued by this branch and enforced by the prosecutorial office that initiated the prosecution.

Alqasi-Mehr, the head of the Tehran Judiciary, stated during a session of the Supreme Judicial Council, referring to the release of two individuals accused of last year's unrests, who were released yesterday on bail after 17 months of detention: The Revolutionary Court, after reviewing the cases of these two individuals, noted that the investigation and collection of definitive information for these two cases had taken a long time, and since the cases were in the Court of Appeals, this court decided, according to the law, to revoke their detention orders. As a result, these two individuals were released on bail.

He further explained that according to Article 242 of the Criminal Procedure Code, it is stipulated that 'the detention period of an accused must not exceed the minimum prison sentence prescribed by law for that crime, and in crimes punishable by the death penalty, the period of temporary detention must not exceed two years, and for other crimes, it must not exceed one year.' He added that the reason for releasing the aforementioned individuals on bail was that, given the duration of their detention, the court was obliged, according to Article 242 of the Criminal Procedure Code, to revoke their temporary detention order. In the near future, the ruling for these two individuals will be issued and communicated by the court.

Earlier, in a footnote on Abdi Media, I had mentioned:

With this noteworthy report from Mizan News Agency regarding the formation of a legal case concerning the hijab issue for Ms. Elaheh Mohammadi and Niloofar Hamedi in the Public and Revolutionary Prosecutor's Office of Tehran, and the insistence on reporting it, it is likely that we will witness an acceleration in the review and issuance of the verdict by the branch handling the appeals for these two esteemed colleagues."
